Welcome to Design Secured (“the Agency,” “we,” “our,” “us”). By purchasing, booking, or engaging in any of our services, you (“the Client”) agree to the following Terms and Conditions. These terms outline the mutual responsibilities, timelines, and policies governing all projects, retainers, and digital products.

1. Scope of Services

Design Secured provides creative, strategic, and digital services including but not limited to:

Brand Identity Design: logos, submarks, brand suites, and visual style guides.

Content Design: digital marketing materials, carousels, templates, flyers, and campaign collateral.

Social Media Services: content creation, caption writing, content planning, and post scheduling.

Publication Design: eBooks, digital guides, magazines, and educational materials.

Website & Funnel Design: website layouts, landing pages, funnels, and CRM integrations.

Course & Program Design: layouts, visuals, and modules for online learning platforms.

Retainer Services: ongoing creative direction and design for recurring clients.

All services are rendered digitally and delivered via the Design Secured Client Portal unless otherwise stated.

2. Onboarding and Client Responsibilities

Project onboarding forms and required materials (logos, brand assets, content, photos, text, etc.) must be completed within 7 days of purchase.
Failure to meet this requirement may pause your project or forfeit your project slot.

The Client agrees to:

Provide complete and accurate content.

Review drafts promptly within assigned feedback windows.

Communicate clearly and professionally through designated channels.

Approve, revise, or finalize projects within the stated timelines.

3. Timelines and Delivery

Project timelines begin only after all content, forms, and payments have been received.
Unless otherwise stated, initial drafts are delivered within 5–7 business days.

Delays in providing content, feedback, or approval will extend project completion times. Design Secured is not responsible for missed deadlines resulting from client delays, content changes, or third-party dependencies.

4. Revisions and Finalization

Each project includes a set number of revisions stated in the service package or invoice.

Revision requests must be submitted within 7 days of receiving a draft.

Projects with no response after 7 days will be automatically marked finalized.

Revisions beyond the included scope will incur additional fees.

5. Retainer Clients

Retainer clients receive ongoing creative services on a recurring schedule.

Retainers include a defined number of design hours or deliverables per month or quarter.

Unused hours or deliverables do not roll over.

Retainers auto-renew unless canceled before the next billing cycle.

Cancellation Policy:
If you wish to cancel a retainer, you will be billed for all individual projects completed during the term, and the remaining unused balance will be refunded. Refunds are calculated after all completed work is deducted at individual project rates.

6. Payment Terms

All payments are due in full before project start, unless a payment plan has been approved.

Deposits are non-refundable.

Payment plans must be completed before the release of any final files.

Failed or late payments may pause or terminate services.

Invoices are issued electronically and payable via approved gateways.

7. Refunds & Cancellations

All sales are final due to the custom and digital nature of our work.

No refunds will be issued once work has begun or drafts have been delivered.

No refunds will be provided for any promotions, flash sales, or digital products.

Refunds for retainers follow the policy in Section 5.

In rare cases where no work has started, a partial refund (minus admin fees) may be approved at the Agency’s discretion.

8. Portfolio Promotion & NDA Clause

Design Secured retains the right to showcase in-progress and completed work in our portfolio, website, marketing materials, and promotional content including social media posts and case studies.

All Portfolio Promotions are intended to build visibility and credibility for both the Agency and our clients.

If you do not wish for your project to be publicly shared, an NDA (Non-Disclosure Agreement) is available for a $150 fee per project.

NDA requests must be made prior to project start.

Work under NDA will not be shown in any public or promotional materials.

9. Intellectual Property & Usage Rights

All creative assets remain the property of Design Secured until full payment is received.
Upon payment completion:

The Client receives a non-exclusive license to use final approved designs for business use.

Source files (AI, PSD, or layered files) are not included unless purchased separately.

Resale, redistribution, or re-licensing of designs without consent is prohibited.

Resell Rights for Digital Products:
Only members of Creative Vault are granted resell rights for approved digital products.
Non-members purchasing Design Secured digital products may not resell, share, or redistribute these assets in any form.

10. Course & Community Materials

Participation in Design Secured courses, programs, or community groups (including Design Secured University, Creative Vault, or related Skool/portal groups) grants personal, non-transferable access to educational materials.

Participants agree that:

All resources, templates, and materials provided are for personal use only.

Content may not be copied, distributed, resold, or shared with individuals outside the community.

Sharing internal materials, templates, or downloads with non-members is a violation of these terms and may result in removal from the community without refund.

11. Communication Policy

All project updates and communication are conducted through the Design Secured Client Portal or official email.
Social media messages, DMs, or comments are not accepted as valid communication.

Office Hours: Monday–Friday, 10 AM–6 PM EST.
Weekend communication is limited to pre-approved or retainer clients.

12. File Storage & Delivery

Final deliverables are stored in the client portal for 14 days after completion.
After this period, file retrieval may require a $25 archival fee.
Clients are responsible for securely downloading and backing up their files.

13. Confidentiality

Design Secured maintains strict confidentiality for all client materials and project details.
This excludes publicly displayed work as part of the agency’s portfolio, unless covered under an active NDA.

14. Limitation of Liability

Design Secured is not liable for:

Project delays caused by the Client’s inaction or late responses.

Errors in content or materials provided by the Client.

Technical or third-party platform issues beyond our control.

Our total liability for any claim shall not exceed the total amount paid by the Client for the specific project.

15. Policy Updates

Design Secured reserves the right to update these Terms & Conditions at any time.
Updates will be posted within the Client Portal and apply immediately to all future projects and renewals.

16. Agreement

By booking, purchasing, or engaging in any Design Secured services, digital products, or communities, you acknowledge that you have read, understood, and agree to these Terms & Conditions in full.
